1. Who this policy applies to
This policy applies to personal information we handle about:
- visitors to our website;
- prospective clients who contact us or book a strategy or demo call;
- our clients and their staff, contractors and representatives;
- individuals who enquire about our clients' services through ads, forms, funnels, chat, SMS, email or phone systems we build or operate on our clients' behalf ("Leads"); and
- business contacts we reach out to through our own or our clients' outreach campaigns.
2. Information we collect
Depending on how you interact with us, we may collect:
- Contact details – name, email address, phone number, business name, job title and business address or service area.
- Enquiry and project details – information you provide about the work you need (for example, project type, location or suburb, budget, timeframe, property details and preferred contact times).
- Booking information – details you provide when scheduling a call, such as your availability and answers to booking questions.
- Communications – the content of emails, SMS, chat messages, social media messages and voice calls with us or with automated systems we operate, including call recordings, transcripts and AI-generated summaries where you have been notified that a call is recorded.
- Client account information – billing details, business information, and access credentials or permissions for advertising, social media, CRM and other platforms you authorise us to manage.
- Publicly available business information – business contact details and information published on business websites, directories, Google Business Profiles, social media and professional networking sites.
- Technical and usage data – IP address, browser and device type, pages visited, referring URLs, ad interactions and similar data collected through cookies, pixels and analytics tools.
We do not intentionally collect sensitive information (such as health information, racial or ethnic origin, or criminal records). Please do not provide sensitive information through our forms or automated systems. If we receive sensitive information we don't need, we will take reasonable steps to delete or de-identify it.
3. How we collect information
We collect personal information:
- directly from you – when you visit our website, book a call (including via our booking calendar, which is provided by LeadConnector / HighLevel), email or call us, or become a client;
- through lead forms and funnels – including native lead forms on platforms such as Facebook and Instagram, landing pages and website forms we build for our clients;
- through automated systems – such as AI chat assistants, AI voice agents, automated SMS and email workflows, and appointment-booking tools;
- from our clients – for example, customer or prospect lists a client asks us to work with; and
- from public sources and data providers – such as business directories, business websites and professional networking platforms, for business-to-business outreach.
If we collect information about you from someone else, we will take reasonable steps to make you aware of that, as required by the APPs.
4. How we use information
We use personal information to:
- respond to enquiries and schedule and conduct calls and consultations;
- provide, manage and improve our services, including running advertising campaigns, funnels and automations;
- capture, respond to, qualify, follow up and route Leads, and book appointments, on behalf of our clients;
- conduct business-to-business outreach about our services or our clients' services;
- measure and report on campaign performance;
- invoice clients, manage accounts and collect payments;
- maintain the security and integrity of our systems and prevent fraud, spam and misuse;
- send you information about our services where permitted by law (you can opt out at any time); and
- comply with our legal obligations and resolve disputes.
5. AI and automated processing
Artificial intelligence is a core part of our services. We use AI and automation tools (including large language models, AI chat assistants, AI voice agents and workflow automation software) to:
- respond to enquiries quickly, including outside business hours;
- ask qualifying questions and summarise enquiries;
- score, categorise and prioritise Leads (for example, by project type, location, budget or timeframe);
- book, confirm and remind people about appointments;
- send follow-up messages by SMS, email or social media messaging;
- research businesses and draft personalised outreach messages; and
- transcribe and summarise calls and conversations.
Talking to an AI. When you interact with one of our AI chat assistants or voice agents, we aim to make it clear that you are dealing with an automated system. You can ask to speak with a person at any time, and we (or the relevant client) will arrange for a human to follow up.
Automated decisions. Our automations may use your information to decide how an enquiry is prioritised, which follow-up messages are sent, or whether an enquiry is passed to a client as a qualified Lead. These decisions are made to manage enquiries efficiently and are not used to make decisions that have a legal or similarly significant effect on you. If you believe an automated outcome has affected you, contact us and we will have a person review it.
AI providers. Information entered into or generated by our AI tools is processed by third-party technology providers on our behalf. We choose providers that maintain appropriate security and, where the option is available, we use settings or agreements that prevent your information being used to train the provider's general AI models. We do not sell personal information.
Accuracy. AI-generated content can be inaccurate. Information or answers given by an AI assistant (for example, about pricing, availability or scope of work) are indicative only and are not a binding quote or offer unless confirmed by the relevant business.
6. Leads we handle for our clients
When you respond to an ad, funnel, form, chat or call that we run for one of our clients (for example, a home improvement business), we collect and process your information on behalf of that client so they can contact you about your enquiry. We will pass your details to that client, and the client's own privacy policy will govern how they use your information after they receive it.
We only use Lead information to provide services to the relevant client. We do not sell Lead information to other businesses or use it to market our own services to you. If you no longer want to be contacted about your enquiry, you can reply STOP to any SMS, use the unsubscribe link in any email, tell the AI assistant or caller, or contact us directly.
7. AI outreach and marketing messages
We conduct outreach to businesses, for ourselves and for our clients, by email, SMS, phone, social media messaging and other channels. Some of this outreach is researched, personalised, sent or followed up using AI tools. When we do this we:
- comply with the Spam Act 2003 (Cth), including only sending commercial electronic messages with consent (express or, where the law allows, inferred – for example, where a business address has been conspicuously published and the message relates to that business's role);
- clearly identify who the message is from and how to contact us;
- include a functional unsubscribe or opt-out option in every commercial message, and action opt-out requests within 5 business days;
- comply with the Do Not Call Register Act 2006 (Cth) and applicable telemarketing standards for voice calls; and
- maintain suppression lists so that people who opt out are not contacted again.
If you have received outreach from us and want to know where we obtained your contact details, or want us to stop contacting you, email sales@axionads.com.au.
8. Who we share information with
We may disclose personal information to:
- our clients – Lead and enquiry details are passed to the business you enquired with;
- service providers who help us operate, such as CRM, marketing automation and scheduling platforms (e.g. LeadConnector / HighLevel), telephony, SMS and email providers, AI model and voice providers, cloud hosting, website and form builders, analytics providers, payment processors and accounting software;
- advertising platforms such as Meta (Facebook and Instagram), Google and TikTok, for example to run, measure and optimise campaigns or build custom audiences;
- professional advisers such as accountants, lawyers and insurers;
- a purchaser or successor if our business, or part of it, is sold or restructured; and
- government authorities, regulators or law enforcement where required or authorised by law.
We require our service providers to handle personal information securely and only for the purposes of providing services to us.
9. Overseas disclosure
Many of the platforms we use (including AI, CRM, scheduling, advertising and cloud providers) store or process data outside Australia, most commonly in the United States, and also in the European Union, the United Kingdom, Singapore and other countries where those providers or their sub-processors operate. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the APPs.
10. Cookies, pixels and analytics
Our website, and the funnels and landing pages we build, may use cookies, tracking pixels (such as the Meta Pixel and Conversions API) and analytics tools (such as Google Analytics) to understand how visitors use our pages, measure ad performance and show relevant ads. Our embedded scheduling tool may also set its own cookies. You can control or block cookies through your browser settings, and you can manage ad preferences through the settings of each advertising platform. Blocking some cookies may affect how the website works.
11. Security and retention
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These include access controls, multi-factor authentication on key accounts, limiting access to staff and contractors who need it, and using reputable providers with strong security practices. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
We keep personal information only for as long as we need it for the purposes described in this policy, to provide our services, or to meet legal, tax and accounting requirements. When we no longer need it, we take reasonable steps to delete or de-identify it. When a client relationship ends, we will return or delete Lead data on request, subject to our legal obligations. If a data breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme where it applies.
12. Access and correction
You can ask to access the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Please contact us using the details below. We will respond within a reasonable time (usually within 30 days). We may need to verify your identity first, and in limited circumstances permitted by law we may decline a request, in which case we will explain why.
If your request relates to Lead information we hold on behalf of a client, we may refer your request to that client or work with them to respond.
13. Complaints
If you have a concern about how we have handled your personal information, please contact us first so we can try to resolve it. We will acknowledge your complaint promptly and aim to respond within 30 days.
If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
14. Changes to this policy
We may update this Privacy Policy from time to time, for example to reflect changes in the law, our services or the technology we use. The updated version will be published on this page with a new "Last updated" date.
